General
By booking La Serra at Turkey Creek Farmstay, you agree to these Terms and Conditions (“T&Cs”). Where a booking is made through a third-party platform such as Airbnb, Booking.com or Stayz, the terms and conditions of that platform also apply. In the event of any inconsistency, the terms of the relevant booking platform may apply to matters governed by that platform.
These T&Cs apply to the person making the booking (“Reservation Holder”) and to all other guests staying at or visiting La Serra (“Guests”). The Reservation Holder is responsible for ensuring that all Guests are aware of and comply with these T&Cs.
Turkey Creek Farmstay is a working rural property. The property contains uneven and natural terrain, dams and waterways, outdoor areas, a fireplace, native wildlife, farm animals, rural equipment and other potential hazards. Guests are expected to take reasonable care and remain aware of their surroundings at all times.
Guests must follow all reasonable directions provided by Turkey Creek Farmstay in relation to safety, property use, animals, equipment and the operation of the property.
The Reservation Holder is responsible for the conduct of all Guests and for any loss, damage or additional costs caused by the Reservation Holder or any Guest during their stay.
If the Reservation Holder or any Guest behaves in a manner that is dangerous, unlawful, disruptive or otherwise inappropriate, Turkey Creek Farmstay reserves the right to require the Reservation Holder and/or Guests to leave the property. In such circumstances, no refund will be provided for unused accommodation.
Damage & Additional Charges
The Reservation Holder is responsible for any damage to La Serra, its contents, furnishings, equipment or surrounding property caused by the Reservation Holder or any Guest.
Where additional cleaning, repairs, replacement items or other costs are required as a result of a stay, the Reservation Holder agrees to pay the reasonable costs incurred.
Where a security deposit or payment authorisation has been taken, Turkey Creek Farmstay may use this to recover legitimate costs associated with damage, excessive cleaning or other charges arising from the booking.
The Reservation Holder authorises Turkey Creek Farmstay to charge the payment method used for the booking for any reasonable and properly incurred additional costs.
Smoking
La Serra and all indoor areas are strictly non-smoking.
Smoking is not permitted inside the accommodation. Any evidence of smoking inside La Serra may result in an additional cleaning and restoration charge to cover reasonable costs associated with cleaning fabrics, furnishings, air conditioning and other affected areas.
Fire & Outdoor Areas
Guests must use the outdoor fire pit and fireplace only in accordance with the instructions provided by Turkey Creek Farmstay.
Fires must never be left unattended and must be completely extinguished before guests retire for the evening or leave the property.
Fire restrictions, weather conditions and local regulations may mean that the fire pit or fireplace cannot be used at certain times.
Noise & Neighbours
Turkey Creek Farmstay is located in a rural environment and guests are expected to respect the surrounding property and neighbours.
Guests must keep noise to a reasonable level at all times and significantly reduce noise after 10.00pm.
Parties, events and functions are not permitted without prior written approval from Turkey Creek Farmstay.
Pets
Pets are not permitted at La Serra unless prior written approval has been provided by Turkey Creek Farmstay.
Accommodation
Check-in is from 3:00pm on the day of arrival.
Check-out is strictly by 11:00am on the day of departure unless a later departure has been agreed to in writing.
Late check-out without prior approval may result in an additional charge.
La Serra is provided solely for short-term holiday accommodation for the number of guests stated on the booking confirmation.
The maximum occupancy of La Serra must not be exceeded.
La Serra is strictly a two-person stay only. No additional guests are permitted.
Additional guests may only stay with prior approval from Turkey Creek Farmstay and may incur an additional charge.
Bookings are non-transferable and may not be sublet or assigned to another person without prior written approval.
Extensions of stay are subject to availability and approval by Turkey Creek Farmstay.
The accommodation may only be used for private holiday purposes. Commercial activities, photoshoots, events, parties, filming or other commercial use require prior written approval.
Children
La Serra is not suitable for children and is strictly an adults-only accommodation for two guests.
Children under 16 years of age are not permitted to stay or visit the property.
Guests aged 16 years and over may be accepted only with prior written approval and must be accompanied and supervised at all times by the Reservation Holder or an approved adult guest (“guided stay”).
The property contains natural rural hazards and outdoor areas. The Reservation Holder is responsible for ensuring compliance with these requirements.
Property Access
Turkey Creek Farmstay respects the privacy of guests.
We reserve the right to access La Serra where reasonably necessary for maintenance, safety, emergencies, repairs or to address a suspected breach of these T&Cs. Wherever reasonably practicable, prior notice will be provided.
Parking
Guests may park in the designated parking area provided for La Serra.
Guests must not park in areas that obstruct access to the property, farm operations, neighbouring properties or emergency vehicles.
Cleaning & Condition of Accommodation
Guests are expected to treat La Serra and its contents with care and leave the accommodation in a reasonably clean and tidy condition.
Please remove personal food and rubbish and leave dishes clean or placed in the dishwasher before departure.
Additional cleaning required as a result of excessive mess, spills, stains, food waste, rubbish or other conditions beyond normal use may incur an additional cleaning charge.
Liability & Rural Property Risks
Guests acknowledge that La Serra is located on a rural property and that there are inherent risks associated with rural environments, including uneven ground, weather conditions, wildlife, farm animals, outdoor facilities and other natural or property-related hazards.
Guests are responsible for taking reasonable care of themselves and their belongings while at Turkey Creek Farmstay.
To the extent permitted by law, Turkey Creek Farmstay is not responsible for loss of or damage to guests’ personal belongings.
Nothing in these T&Cs excludes, restricts or modifies any rights or remedies that cannot legally be excluded under Australian Consumer Law or other applicable legislation.
Payment
Full payment is required at the time of booking unless otherwise agreed.
All prices are in Australian dollars and include GST where applicable.
Payments made through third-party booking platforms are subject to the payment terms and conditions of that platform.
Cancellation Policy
Cancellation, rebooking or rescheduling requests must be made in writing.
Our cancellation policy is as follows:
More than 30 days before arrival
Guests may cancel their booking and receive a full refund, less any non-refundable payment processing or third-party fees where applicable.
Alternatively, guests may request to move their booking to another available date, subject to availability and any applicable rate difference.
Between 30 and 7 days before arrival
50% of the booking total will be forfeited.
The remaining 50% may be offered as a credit towards a future stay, subject to availability.
Within 7 days of arrival
100% of the booking total will be forfeited and no refund or credit will be provided.
No-show
If a guest does not arrive for their booking, the booking will be treated as a cancellation within 7 days of arrival and no refund or credit will be provided.
Government restrictions
If government restrictions or legally enforceable requirements prevent the Reservation Holder from lawfully travelling to or staying at La Serra, Turkey Creek Farmstay will work with the Reservation Holder to reschedule the booking or provide a credit, subject to availability.
Any credit issued must be used within 2 years of the original booking date unless otherwise agreed.
Early departure
No refund or credit will be provided for unused nights where a guest chooses to shorten their stay after arrival.
Direct Bookings & Third-Party Platforms
Bookings made directly through the Turkey Creek Farmstay website are subject to these T&Cs and the cancellation policy selected at the time of booking.
Bookings made through Airbnb, Booking.com, Stayz or another third-party platform are also subject to that platform’s terms, policies and cancellation conditions.
Where a third-party platform’s policies govern a particular aspect of a reservation, those policies will apply to the extent required by that platform.
Acceptance
By completing a booking at La Serra, the Reservation Holder confirms that they have read, understood and agreed to these Terms and Conditions and accepts responsibility for ensuring that all Guests comply with them.
